Sec. 37-85. Penalty.

 

Any person who shall violate any of the provisions of this division shall, for a first violation, be deemed guilty of a class 4 misdemeanor; for each second or subsequent conviction under this division, committed within twelve (12) months from the date of a prior conviction hereunder, any such person shall be deemed guilty of a class 3 misdemeanor.
