Sec. 35.1-20. Violations and penalties.
(a) Violations and penalties. Any person who violates any provision of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction by the judge of the general district court for the City of Lynchburg, shall be fined not less than ten dollars ($10.00). nor more than one thousand dollars ($1.000.00) for each offense, the amount of such fine to be determined by the courts. Each day that the offense continues shall be a separate offense.
(b) Prevention of illegal proceedings. In case any building or structure is erected, constructed, altered, repaired or converted or any building, structure or land is used in violation of this ordinance, the proper authorities of the city, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, repair or conversion, or restrain, correct or abate such violation, to prevent the occupancy of such building, structure or land or to prevent any illegal act, conduct, business or use in or about such premises.
When a building permit has been issued and the construction of the building for which such permit was issued is subsequently sought to be prevented, restrained, corrected or abated as a violation of the zoning ordinance, by suit filed within fifteen (15) days after the start of construction by a person who had no actual notice of the permit, the court may hear and determine the issues raised in the litigation even though no appeal was taken from the decision of the administrative officer to the board of zoning appeals.
